IGV FAMILY GAME ROOM PASS SUBSCRIPTION SERVICE ON PLDT
TERMS AND CONDITIONS

The IGV FAMILY GAME ROOM PASS SUBSCRIPTION SERVICE ON PLDT (the “IGV Family Game Room Pass Subscription” or the “Service”), a service provided by SportsHero Enterprise Pte. Ltd. (“SHO”), is a monthly subscription service that allows users to access a shared library of over two hundred (200) games with exclusive game saves. Users benefit from cloud saves, real-time customer support, and the convenience of launching games with a single click via the IGV client, resulting in cost savings for gamers seeking broad access to games without individual purchases.

PLDT Inc. (“PLDT”) will provide the Service in accordance with these terms and conditions (“PLDT Terms and Conditions”) and in compliance with the applicable rules and regulations of the National Telecommunications Commission (“NTC”) and other appropriate government agencies.

1. IGV Family Game Room Pass Subscription. The Service is a subscription service currently made available to all new and existing subscribers of select and eligible broadband postpaid subscription plans of PLDT (the “Subscribers”), which excludes employee plans and is subject to the eligibility requirements set by PLDT.
2. Subscription Package.
   1. The Service is available for free for a period of twelve (12) months from the date of activation of the voucher; provided that, such activation is completed within the validity period specified in the voucher.
3. Usage
   1. Each availment of a select and eligible broadband postpaid subscription plans of PLDT ("PLDT Subscription Account") shall entitle the Subscriber to one (1) IGV Family Game Room Pass Subscription.
   2. By accessing and using IGV Family Game Room Pass Subscription through PLDT, the Subscriber is required to continue complying with the terms and conditions governing PLDT’s landline and broadband services (“PLDT Services Terms and Conditions”), which may be viewed at https://pldthome.com/terms-and-conditions, as well as these PLDT Terms and Conditions and all applicable terms and conditions of the Service by SHO (the “SHO Terms and Conditions”). By availing of the Service, the Subscriber acknowledges that they have read, understood, and agreed to comply with the PLDT Services Terms and Conditions, the PLDT Terms and Conditions, and the SHO Terms and Conditions (collectively the “Terms and Conditions”). The Subscriber further agrees that the access and use of the Service may be subject to such further terms and conditions as may be imposed by PLDT and/or SHO from time to time.
   3. The Service is a third-party application not owned, operated, or secured by PLDT. PLDT does not provide any representations and warranties regarding the Service and is not responsible for the security, privacy, functionality, availability, or continuity of the Service. The Subscriber acknowledges and accepts all risks associated with their past, present, and future access to and use of the Service. PLDT shall not be liable or responsible for any loss, damage, or harm suffered or incurred by the Subscriber that may arise by reason of or in connection with their access or use of the Service.
   4. PLDT shall not be liable to the Subscriber or any party using the Subscriber’s account, with or without the Subscriber’s permission, to access the Service for any claim or liability whatsoever (including loss of data, profits, loss of savings, or incidental or consequential damages), even if PLDT had been advised of the possibility of such damages, or for any claim by any other person.
   5. Subscriber shall hold PLDT, together with its directors, officers, and employees, free and harmless from, and shall indemnify them for any liability arising from, any and all suits, actions, and/or claims made by any person, natural or juridical, against the Subscriber or PLDT arising from the access and use of the Services by the Subscriber (or any party using the Subscriber’s account, with or without the Subscriber’s permission). Notwithstanding anything contained herein to the contrary, any liability adjudged against PLDT in connection with or arising from the Service shall be limited to the payment of the most recent charges actually paid by the Subscriber to PLDT for the Service.
   6. The Service is intended for personal, non-commercial use and restricts simultaneous logins to one device per account only. The Subscriber’s right to access and use the Service is personal to the Subscriber. The Subscriber agrees not to resell or to make any commercial use of the Service (the “Unauthorized Activities”), without the prior express written consent of PLDT.
      
      The Subscriber further undertakes not to use the Service for any activity that is contrary to morals and public policy or which violates any ordinance, law, decree, order, regulation, or treaty (the “Illegal Activities”). PLDT reserves the right to suspend or terminate the subscription to the Service immediately upon notice from a competent authority that the Service is being used in violation of the Anti-Child Pornography Act, as amended or any law. I agree that no refund shall be given in case of termination due to violation of this paragraph.
      
      The Subscriber agrees to indemnify and hold PLDT free and harmless from any liability, suit, or damage arising from or connected with the Subscriber’s Unauthorized and/or Illegal Activities. The Subscriber further authorizes PLDT to supply any and all information requested by any law enforcement or government agency/ies or other private entities, the latter within the limits provided by law, relative to the Subscriber’s subscription to the Service. In which case, the Subscriber hereby irrevocably and unconditionally waives any and all its relevant remedies under the law, including but not limited to the right to claim damages.
4. Disconnection
   1. The Service will not be accessible if the PLDT Subscription Account associated with the Service is categorized or provided a Notice of Disconnection or under Call Restriction.
   2. The IGV Family Game Room Pass Subscription will be automatically cancelled once the PLDT Subscription Account associated with the Service is permanently disconnected.
   3. Subject to existing provisions of law, violation of any of the provisions of the Terms and Conditions shall give PLDT the right to immediately disconnect the Service without incurring liability for damages. Such disconnection shall not relieve the Subscriber from any monetary obligations accruing prior to the disconnection or from any liability to PLDT as a consequence of such violation.
5. Aftersales. For any concerns or assistance after activation, the Subscriber may contact PLDT Customer Care at 171.
6. Disclaimer. PLDT provides Service on an “as is” basis, without any express warranty or representation of any kind. PLDT expressly disclaims any liability for issues arising from SHO’s authority to distribute the Service in the Philippines. Furthermore, PLDT expressly disclaims all implied warranties and representations, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. General Terms and Conditions
   1. Collection Agency Fees. In case it will be necessary for PLDT to resort to court action or litigation, or use the services of a collection agency, the Subscriber shall pay a penalty of 25% of the amount due as collection fees or attorney's fees, in addition to damages or billing for services, penalty, charges, and surcharges.
   2. Non-Transferability. The Service may not be assigned or transferred by the subscriber without the prior written consent of PLDT. Any assignment or transfer made without the necessary PLDT consent shall be void and PLDT shall have the right to continue to make the subscriber on record liable under the pertinent terms and conditions as if no such assignment or transfer was made.
   3. Amendment. PLDT reserves the right to amend any of the provisions of any of the foregoing terms and conditions. Any such amendment shall take effect thirty (30) days from notice to the subscriber, through whatever means, or by posting at the pertinent PLDT website. The continued use and availment of the Service shall give the undisputed presumption that the Subscriber fully agrees and undertakes to adhere to such amendments.
   4. Rights Cumulative. All rights, power, or remedies under the foregoing terms and conditions granted to PLDT shall be cumulative and not alternative and shall be in addition to and not in substitution for and in derogation of the rights, power, and remedies conferred to PLDT by law.
   5. Non-Waiver. The failure of PLDT to enforce any of its rights under these terms and conditions or any portion thereof, for whatever reason, shall not be construed as a waiver of such right.
   6. Severability. The Subscriber agrees that if a court of competent jurisdiction declares any portion of the Terms and Conditions to be invalid or unenforceable, that portion will be construed consistent with applicable law as possible, and the remaining portions will be in full force and effect.
   7. Venue of Action. The parties agree that the venue of all actions from any of the foregoing terms and conditions shall be the court of proper jurisdiction of Makati City, Metro Manila, Philippines to the exclusion of any other venue.

IGV FAMILY GAME ROOM PASS PRIVACY NOTICE

In partnership with SportsHero Enterprise Pte Ltd (“SHO”), PLDT Inc. (“PLDT”) brings to you an alternative way to pay for your IGV FAMILY GAME ROOM PASS Subscription Service (the “Subscription” or the “Service”). Through Direct Carrier Billing (“DCB”), you may now charge the cost of your Subscription to your PLDT Home monthly bill.

In compliance with the Data Privacy Act, we share with you the principles that govern how your personal data will be collected and processed when you claim and redeem an IGV Game Pass (the “IGV Voucher”) or choose to pay for your Subscription through DCB.

How we process your Personal Data

We process your PLDT Home Account Name and Account Number so that we may correctly provide you with the free 1-year access to the Service (if you are eligible for an IGV Voucher) or to process the DCB for your IGV Family Game Room Pass subscription.

You must have an account on the IGV website (www.igv.ph) to access the Service. Please note that creating an account on the IGV website entails a separate agreement between you and SHO, to which PLDT is not a party. Your use of the Service is governed by SHO’s Terms and Conditions and Privacy Policy.

How your Personal Data is protected

The integrity, confidentiality, and security of your personal data is important to us. This is why we strictly enforce this Privacy Notice within PLDT and have implemented technical, organizational, and physical security measures that are designed to protect your information from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful activities. Your personal data is also protected from other natural and human dangers.

When activating DCB as your payment method for your Subscription, we assign a unique pseudonym identifier to your profile as a security measure to protect your personal data in the process of transmitting the same to SHO so that they may activate your Service.

Your rights and choices

The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under the law, you are entitled to request:

• Access to the personal data we process about you;
• Rectification of your personal data if it is found to be outdated, inaccurate, or incomplete;
• Erasure when it is no longer needed to achieve the legitimate purpose of its processing;
• Restriction of processing of your personal data in limited circumstances;
• Portability of your personal data so that you may receive a copy thereof or that we transmit the same to another company on your behalf.

Depending on the circumstances, you may also have the right to object to the processing of your personal data.

To exercise any of these rights, you may get in touch with our Data Privacy Officer through the contact details provided below. In some instances, we may request for supporting documents or proof before we effect any requested changes to your personal data.

If, despite our commitment and efforts to protect your personal data, you believe that your data privacy rights have been violated, we encourage you to come to PLDT first so that we can work together to resolve your complaint. You have the right at all times to register a complaint directly with the National Privacy Commission or to make a claim against us with a competent court.
