TERMS AND CONDITIONS
(PLDT HOME FIBER PREPAID)

PLDT Home prepaid plans1 are prepaid consumer products available to residential subscribers, where product is used at home or at their place of residence for the social or domestic affairs of the household and only where the prepaid data service will be installed and made available.

PLDT Inc. (“PLDT”) will provide the service in accordance with the following terms and conditions and in compliance with the applicable rules and regulations of the National Telecommunications Commission (NTC) and other appropriate government agencies.

  1. PLDT Home Fiber Prepaid. The PLDT Home Fiber Prepaid (“Fiber Prepaid”), previously known as the PLDT Home Prepaid Fiber, is a prepaid data only service currently made available to (i) new subscribers, and (ii) existing Fiber Postpaid plan subscribers, subject to the following PLDT eligibility rules:
    1. Fiber Prepaid – New subscribers. Upon submission of duly accomplished and signed customer application form with subscriber declaration, completion of required steps, and payment of the one-time fee for the modem and installation, PLDT shall proceed to process the application and install the Fiber Prepaid service.
    2. Fiber Prepaid – Converted from terminated Postpaid Fiber plan. Upon voluntarily or involuntarily terminating the subscriber’s existing Postpaid Fiber plan subscription and upon confirmation of eligibility, any remaining unpaid balance from the Postpaid Fiber plan subscription (monthly service fee and termination fee, as may be applicable) will be sent to the subscriber for settlement, and the subscriber’s service will immediately be converted and reactivated as Fiber Prepaid. The subscriber will not be in any way obliged to use the Fiber Prepaid service and will not be charged with any additional fees outside the remaining unpaid balance. The subscriber will only be charged for the Fiber Prepaid service on a pay per use basis.
      Upon conversion to the Fiber Prepaid service, the telephone/landline service will also be disconnected. The landline number previously part of the subscriber’s Fiber Postpaid subscription plan shall be held in quarantine upon disconnection of the Postpaid account and may be recycled and reassigned to a new subscriber, subject to the internal rules of PLDT.
    Fiber Prepaid is available nationwide in areas covered by the PLDT Home Fiber facility and may be subject to a facility check as may be determined by PLDT.
  2. Loading of Data Packages.The Fiber Prepaid service requires for its use the loading of data packages specific to the Fiber Prepaid service. The data packages may be availed through PLDT’s MyHome website, with payment to be made via authorized or accredited payment channels. After loading the value into the prepaid account, such data packages shall be valid for the specific period of time as may be determined by PLDT. It shall be the subscriber’s responsibility to be informed of the validity and specific terms and conditions of any data package availed of, loaded, or purchased. PLDT reserves the right to discontinue the Fiber Prepaid service in the event that no reload activity is registered or observed for a continuous period of one hundred eighty (180) days from the date of expiration of the data package purchased. The data packages or corresponding values are non-refundable and non-replaceable either in part or full.
  3. Usage Monitoring. The subscriber can monitor the internet usage through the subscriber’s MyHome account. .
  4. Termination / Processing Fee. The Fiber Prepaid service shall be permanently disconnected if: (i) the subscriber fails to comply with the terms and conditions of the Fiber Prepaid service, and/or (ii) the subscriber is unable to reload value into the account every one hundred eighty (180) consecutive days from the expiration of the last top up. Disconnected Fiber Prepaid service may not be reconnected. In case of disconnection, the subscriber must apply for a new service to continue availing of the Fiber Prepaid service.
  5. Relocation. The subscriber understands and agrees that should the subscriber relocate to a new address, the subscriber’s Fiber Prepaid subscription will be disconnected and a new application for Fiber Prepaid subscription must be submitted and processed, subject to the confirmation of serviceability given the available facilities in the new address, to be able to enjoy the Fiber Prepaid service.
  6. Ownership. All devices are owned by PLDT except as otherwise provided herein. Should the PLDT-owned devices be defective or destroyed without the subscriber’s fault or negligence, upon the subscriber’s request, PLDT shall replace such devices at no additional cost. However, should the devices become defective or destroyed due to the subscriber’s fault or negligence, the subscriber shall be obliged to pay PLDT the total device cost of the damaged device/s before PLDT provides a replacement.

    Modem ownership of select PLDT Home Fiber Postpaid accounts within lock-in period that are converted to PLDT Home Fiber Prepaid will be transferred to the subscriber upon settlement of the pretermination fee of the previous PLDT Home account.
  7. General Terms and Conditions for PLDT Home Fiber Prepaid:
    1. Data Service. The PLDT data service for prepaid plans shall consist of Fiber services (the “PLDT Data Services - Prepaid”).
    2. Minimum Speed and Service Reliability Applicable to Broadband Data Services. PLDT guarantees a minimum broadband speed of 256 kbps across all plans. Said guarantee however excludes factors outside the control of PLDT which, among others, include the length of fiber wire from the PLDT exchange to the subscriber’s premises; the number of other services being used over fiber pairs in the same cable by other subscribers; the configuration and line quality of the fiber wire pair between the PLDT exchange and the subscriber’s premises; electrical interference from outside sources (such as electric motors or other electronic devices); the configuration of the fiber wiring within the subscriber’s premises; the software configuration and application on the subscriber’s computer (in particular how it uses the uplink back to the PLDT exchange); the subscriber’s hardware or modem; and the capacity of load or access data rate of the destination host computer or website which the subscriber is accessing and the number of computers connected to the broadband service.
    3. Bandwidth, Data Storage and Other Limitations. The subscriber shall comply with the current bandwidth, data storage, and other limitations of the PLDT Data Services - Prepaid. The subscriber shall ensure that the subscriber’s activity does not improperly restrict, inhibit, or degrade PLDT’s or any other party’s use of the PLDT Data Services- Prepaid nor represent (in PLDT’s sole determination) an unusually large burden on the PLDT network.

      The PLDT residential service offering is a consumer product designed for subscriber’s exclusive and personal use of the Internet only. The subscriber shall not run a server in connection with the PLDT Data Services - Prepaid or connect more than the agreed number of terminals, nor shall subscriber provide network services to others via the PLDT residential service.
    4. Service Commitment, Additional Charges, and Property Rights. Charges to the load packages due to PLDT shall continue to apply without deductions even in case of service interruption. Due to the nature of the Internet, PLDT does not warrant fast and efficient Internet access to be available at all times. However, PLDT shall exert its best efforts to ensure continuous fast Internet at the premises of the subscriber.

      PLDT owns the property rights and interest in the PLDT Data Services - Prepaid and all that is attached to the system. The subscriber hereby undertakes to uphold the property rights and interest of PLDT and hereby binds itself to refrain from taping, recording, duplicating, or otherwise reproducing, in any manner and form whatsoever and for any purposes, the programs, trademarks/logos, copyrights, and services received by and passed to him/in under and by reason of these terms and conditions.
    5. Acceptable Use Policy. PLDT supports and promotes good citizenship within the Internet community and will respond appropriately in the event that PLDT becomes aware of any inappropriate use of its service. PLDT has the right to monitor bandwidth and usage, and from time to time identify violations of the Acceptable Use Policy or any inappropriate use of the PLDT service and/or to protect the PLDT network and other customers in its network.

      If PLDT services are used in a way which PLDT would consider inappropriate, PLDT will take action as it may deem necessary, which may include, but is not limited to, preventing access to the PLDT service/s that were inappropriately used or were used in connection with, or resulting in, the violation of the Acceptable Use Policy, without incurring any liability for damages, or as may otherwise be directed by government agencies or the courts pursuant to applicable laws. Inappropriate use generally means any activity that is contrary to morals and public policy or which violates any ordinance, law, decree, order, regulation, or treaty, including any violation of Republic Act No. 11930 or the Anti-Online Sexual Abuse or Exploitation of Children (OSAEC) and Anti-Child Sexual Abuse or Exploitation of Materials (CSAEM) Act, Republic Act No. 9775 or the Anti-Child Pornography Act of 2009, and Republic Act No. 9208 or the Anti-Trafficking in Persons Act of 2003, or any and all succeeding amendments thereof. PLDT reserves the right to suspend or terminate the Fiber Prepaid service or any part hereof immediately upon notice from a competent authority that the Fiber Prepaid service is being used in violation of the any law or upon knowledge that its network, facilities or services are being used for the delivery, transmission, or storage of any form of sexual abuse or exploitation of children, or any form of child sexual abuse or exploitation materials and/or any acts which the law considers as violation of law or laws relative thereto.
    6. Reselling / Illegal / Prohibited Use. The subscriber’s right to use the Fiber Prepaid service is personal to the subscriber. The subscriber agrees not to resell or to make any commercial use of the service, without the prior express written consent of PLDT. The PLDT services shall not be utilized in bypassing or in activity/ies that tend to bypass the Public Subscriber Telephone Network (PSTN) of PLDT or be used in prohibited service like callback, dialback, unauthorized audio text, International and National Simple Resale 9ISR/NSR) and other similar services (the “Unauthorized Activities”). PLDT is entitled to a bypass compensation fee on account of any of the above Unauthorized Activities. The bypass compensation payable is reckoned, without any limitation, from the time the Unauthorized Activity accrued or was discovered by PLDT, whichever is earlier, until the actual cessation thereof. For this purpose, PLDT shall have the right to full access to the relevant books and all other records of the subscriber in order to ascertain the volume of traffic and total amount of bypass compensation payable. In the absence of said record, PLDT shall have the sole discretion in the determination of the bypass compensation. In addition to the Unauthorized Activities referred to above, the subscriber undertakes not to use the PLDT service for any activity that is contrary to morals and public policy, or which violates any ordinance, law, decree, order, regulation, or treaty (the “Illegal Activities”).

      The subscriber agrees to indemnify and hold PLDT free and harmless from any liability, suit or damage arising from or connected with the subscriber’s Unauthorized and/or Illegal Activities. The subscriber further authorizes PLDT to supply any and all information requested by any law enforcement or government agency/ies or other private entities, the latter within the limits provided by law, relative to the subscriber’s subscription to the Fiber Prepaid service. In which case the subscriber hereby irrevocably and unconditionally waives any and all its relevant remedies under the law, including but not limited to the right to claim damages.
    7. Customer Premises Equipment (CPE). PLDT-Owned CPE shall refer to PLDT-provided modem-routers, cable including connections and other accessories (collectively, “CPE”) which PLDT has provided and installed at the subscriber’s premises, and shall remain as PLDT’s property. The equipment shall be pulled-out and/or returned to PLDT upon termination of the service.

      The subscriber should take proper care of the CPE, should not remove the same from the place of connection nor directly or indirectly allow the connection, disconnection, movement and/or alteration of such equipment by any person other than our authorized personnel.

      Full administrator rights to PLDT-provided modem-routers are not provided to the subscriber due to the security risks involved for the user, except with respect to customer-owned attachment.
    8. Customer-Owned Attachment.For customer-owned attachment, the subscriber agrees to be solely responsible for any security breach that may arise from the use thereof and agrees to pay for all charges as a result of such security breach. In case a customer-owned attachment affects or impairs the quality of the Fiber Prepaid service, PLDT shall have the right to demand the immediate disconnection of the use thereof.
    9. Change in Fees / Charges. PLDT reserves the rights to increase any of the fees and charges or impose new or additional fees and charges applicable to the Fiber Prepaid service, subject to approvals from the NTC or other government agency/ies having jurisdiction over the approval thereof.
    10. Taxes and Other Charges. Any and all taxes including value-added tax (VAT) and/or Overseas Communications Tax (OCT), when applicable, charges, fees, and other imposts that may be imposed by the government of the Republic of the Philippines or any of its instrumentalities or other applicable authority in connection with or incidental to the provision of the Fiber Prepaid service shall be for the sole account of the subscriber.
    11. Disclaimer and Limitation of Liability. Except as provided under the foregoing terms and conditions, PLDT gives no warranty with respect to the speed and quality of data and software/internet access of the subscriber and shall not be liable to the subscriber for any claim or liability whatsoever (including loss of data, profits, loss of savings or indirect, incidental, special, or consequential damages) arising out of the subscriber’s use of or inability to use the Fiber Prepaid service or the software/internet access, even if PLDT had been advised of the possibility of such damages, or for any claim by any other person.

      In the event of any service interruption, PLDT shall not be liable for any and all damages that may be suffered by the subscriber for the service interruption.

      Subscriber shall hold PLDT, its directors, officers, and employees free and harmless from, and shall indemnify them for any liability arising from any and all suits, actions and/or claims made by any person, natural or juridical, against the subscriber or PLDT arising from the subscriber’s use of the Fiber Prepaid service. Notwithstanding anything contained herein to the contrary, any liability adjudged against PLDT in connection with or arising from the service shall be limited to the payment of the most recent charges actually paid by the subscriber to PLDT.
    12. Disconnection. ubject to existing provisions of law, violation of any of the foregoing provisions shall give PLDT the right to immediately disconnect the Fiber Prepaid service without incurring liability for damages. Such disconnection shall not relieve the subscriber from any monetary obligations accruing prior to the disconnection or from any liability to PLDT as a consequence of such violation.
    13. Collection Agency Fees. In case it will be necessary for PLDT to resort to court action or litigation, or use the services of a collection agency, the subscriber shall pay a penalty of 25% of the amount due as collection fees or attorney's fees, in addition to damages or billing for services, penalty, charges, and surcharges.
    14. Non-Transferability. The Fiber Prepaid service and the CPE, including any of the foregoing terms and conditions may not be leased, assigned or transferred by the subscriber without the prior written consent of PLDT. Any lease, assignment or transfer made without the necessary PLDT consent shall be void and PLDT shall have the right to continue to make the subscriber on record liable under the pertinent terms and conditions as if no such lease, assignment or transfer was made.
    15. Amendment. PLDT reserves the right to amend any of the provisions of any of the foregoing terms and conditions. Any such amendment shall take effect thirty (30) days from notice to the subscriber, through whatever means, or by posting at the pertinent PLDT website. The continued use and availment of the Fiber Prepaid service shall give the undisputed presumption that the subscriber fully agrees and undertakes to adhere to such amendments.
    16. Rights Cumulative. All rights, power, or remedies under the foregoing terms and conditions granted to PLDT shall be cumulative and not alternative and shall be in addition to and not in substitution for and in derogation of the rights, power, and remedies conferred to PLDT by law.
    17. Non-Waiver. The failure of PLDT to enforce any of its rights under these terms and conditions or any portion thereof, for whatever reason, shall not be construed as a waiver of such right.
    18. Severability. The subscriber agrees that if a court of competent jurisdiction declares any portion of the pertinent terms and conditions governing the Fiber Prepaid service to be invalid or unenforceable, that portion will be construed consistent with applicable law as possible, and the remaining portions will be in full force and effect.
    19. Venue of Action. The parties agree that the venue of all actions from any of the foregoing terms and conditions shall be the court of proper jurisdiction of Makati City, Metro Manila, Philippines to the exclusion of any other venue.

The terms and conditions (including any amendment) governing the use of the Fiber Prepaid service shall also be found in www.pldthome.com (the “Website”). The subscriber agrees to consult the Website for the most updated version of the terms and conditions. In the event of conflict between these terms and conditions and the terms and conditions posted on the Website, the terms and conditions posted on the Websites shall prevail.

DATA PRIVACY

As a condition for your use of the Fiber Prepaid service, you acknowledge that you have read and understood the Subscriber Declaration set forth in the application form for the Prepaid Fiber service, which outlines the general principles governing the collection, use, and sharing of your personal data, along with PLDT’s privacy practices.
